  • Love and XO Julia, an Oregon Company (“Company” or “We”) respect your privacy and are committed to protecting it through our compliance with this Privacy Policy and General Terms (“Privacy Policy”).

    This Privacy Policy describes the types of information we may collect from you or that you may provide when you visit our website, loveandxojulia.com and all web pages, features, and services relating to our website (collectively, our “Site”) and our practices for collecting, using, maintaining, protecting, and disclosing that information, in addition to various terms of use relating to our Site as provided below.

    Please read the Privacy Policy carefully before you start to use the Site. By accessing or using the Site, you accept and agree to be bound and abide by all provisions this Privacy Policy. If you do not want to agree to this Privacy Policy, you must not access or use the Site.  

    This Privacy Policy applies to information we collect:

    • In email, text, and other electronic messages between you and this Site.
    • Through mobile applications, if any, that you might download from this Site, which provide dedicated non-browser-based interaction between you and this Site.

  • CHILDREN UNDER THE AGE OF 13
  • The Children's Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians (collectively, “parents”) about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“children”). It also requires us to obtain verifiable consent from a child's parent for certain collection, use, and disclosure of the child's personal information.

    Information We Collect from Children

    A child must provide us with the following information to register with this Site: the child's first name, birth date, and a parent's email address. We may also require the child to create a member name and password. We may request additional information from your child, but this information is optional. We specify whether information is required or optional when we request it.

    We use technology to automatically collect information from our users, including children, when they access and navigate through the Site and use certain of its features. The information we collect through these technologies may include: 

    • One or more persistent identifiers that can be used to recognize a user over time and across different Sites and online services.

    How We Use Your Child's Information

    We use the personal information we collect from your child to: 

    • register the child’s account with the Site;
    • communicate with the child about activities, products, or features of the Site that may be of interest;
    • keep our Site operational and secure;
    • create anonymous data that might include aggregated data such as statistical data or demographic data (such anonymous data may be derived from personal information that we collect, but will not include the child’s personal information once it is in anonymous / aggregated form);

    Accessing and Correcting Your Child's Personal Information

    At any time, you may review the child's personal information maintained by us, require us to correct or delete the personal information, and/or refuse to permit us from further collecting or using the child's information.

To protect your privacy and security, we may require you to take certain steps or provide additional information to verify your identity before we provide any information or make corrections.

  • GENERAL TERMS 
  • We reserve the right to withdraw or amend this Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Site, or the entire Site, to users, including registered users. The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

    You are permitted to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

    Trademarks

    The Company name, the term “Love and XO Julia” and variations thereof, the Company’s logo, the Site logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors, whether in registered or unregistered form. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

    Prohibited Uses

    You may use the Site only for lawful purposes and in accordance with this Privacy Policy. You agree not to use the Site:

    The Company is based in the State of Oregon in the United States. We provide this Site for use only by persons located in the United States. We make no claims that the Site or any of its content is accessible or appropriate outside of the United States. Access to the Site may not be legal by certain persons or in certain countries. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Site like message boards.   • GOVERNING LAW AND JURISDICTION

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

  • WAIVER AND SEVERABILITY
  • No waiver by the Company of any term or condition set out in this Privacy Policy shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under this Privacy Policy shall not constitute a waiver of such right or provision.

    If any provision of this Privacy Policy is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason or with respect to a particular application, such provision shall be eliminated or limited only with respect to such reason or particular application to the minimum extent such that the remaining provisions of this Privacy Policy will continue in full force and effect.
